What is maternity leave benefit?

Korean labor law guarantees 90 days of pre/post-natal leave (120 for multiples) at 100% of ordinary wage. In priority-support firms (most SMEs/mid-caps), the entire benefit is paid by employment insurance. In large firms, the employer pays the first 60 days (80 for multiples) and the government pays the final 30 days (40). The government portion is capped at 2,100,000 KRW per month.

Frequently asked questions

Who counts as a priority-support firm?
Defined by employee count thresholds in the Employment Insurance Act. Manufacturing ≤500, mining/transport/telecom ≤300, retail/lodging/food ≤200, etc. Confirm with HR or the EI portal.
How is the leave split before and after birth?
By default 45 + 45 days for singles (60 + 60 for multiples). Pre-birth portion can be longer with medical reasons (split use). The post-birth 45 days is mandatory and cannot be shortened.

How do I claim?
Your employer reports the leave via the EI EDI system, then you file the claim each month or after leave ends at ei.go.kr. Must be filed within 12 months of leave end.
